Restitution, Fines and Costs in Criminal Matter Not Dischargeable

Restitution, Fines, and Costs are not dischargeable and not effected by the automatic stay. However, it does not prevent the discharge of other debts to make it easier for a defendant to pay restitution, fines , and costs.  Additionally, if restitution, fines , and costs are paid with a credit card or other dischargeable debt, they are dischargeable.  For example, using a visa card to pay restitution, fines, and costs, and then filing for bankruptcy.  They would be dischargeable.
